Se amplia plazo para inscripción al Registro de Prestadoras de Servicios Especializados u Obras Especializadas
El pasado 31 de julio del 2021 se publicó en el Diario Oficial de la Federación el “Decreto por el que se reforman, adicionan y derogan diversas disposiciones de la Ley Federal del Trabajo; de la Ley del Seguro Social; de la Ley del Instituto del Fondo Nacional de la Vivienda para los Trabajadores; del Código Fiscal de la Federación; de la Ley del Impuesto sobre la Renta; de la Ley del Impuesto al Valor Agregado; de la Ley Federal de los Trabajadores al Servicio del Estado, Reglamentaria del Apartado B) del Artículo 123 Constitucional; de la Ley Reglamentaria de la Fracción XIII Bis del Apartado B, del Artículo 123 de la Constitución Política de los Estados Unidos Mexicanos, en materia de Subcontratación Laboral”, publicado el 23 de abril de 2021.
Derivado de diversos problemas en la plataforma para llevar acabo el registro al Registro de Prestadoras de Servicios Especializados u Obras Especializadas (REPSE), como lo fueron la imposibilidad del llenado de cuestionarios, cruce de opiniones del cumplimiento de los sistemas que no coincidían con la realidad del contribuyente, entre otros, resulto necesario una prorroga en el plazo para la inscripción a dicho padrón, ya que los contribuyentes no podían completar su registro en el plazo inicial otorgado, de acuerdo con el decreto antes mencionado en el artículo tercero transitorio se establece lo siguiente:
“Tercero. A la fecha de entrada en vigor del presente Decreto, las personas físicas o morales que presten servicios de subcontratación, deberán obtener el registro ante la Secretaría del Trabajo y Previsión Social que prevé el artículo 15 de la Ley Federal del Trabajo, a más tardar el 1 de septiembre de 2021.”
Te recordamos que es de suma importancia tener todos los documentos necesarios para la inscripción al padrón a la mano para el registro como lo son:
- firma vigente
- Constancia de situación fiscal
- Acta constitutiva para personas morales
- Opinión del cumplimiento en sentido positivo del SAT, IMSS, INFONAVIT

On July 31, 2021, the “Decree amending, adding and repealing several provisions of the Federal Labor Law; of the Social Security Law; of the Law of the National Workers’ Housing Fund Institute; of the Federal Tax Code; of the Income Tax Law; of the Value Added Tax Law; of the Federal Law of Workers in the Service of the State, Regulatory of Section B) of Article 123 of the Constitution; of the Regulatory Law of Section XIII of Article 123 of the Constitution; of the Federal Law of Workers in the Service of the State, Regulatory of Section B) of Article 123 of the Constitution; of the Law of Section XIII of Article 123 of the Constitution; of the Value Added Tax Law; of the Federal Law of Workers in the Service of the State, Regulatory of Section B) of Article 123 of the Constitution; of the Regulatory Law of Section XIII Bis of Section B, of Article 123 of the Political Constitution of the United Mexican States, in matters of Labor Subcontracting”, published on April 23, 2021.
Due to several problems in the platform to carry out the registration to the Registry of Specialized Services Providers or Specialized Works (REPSE), such as the impossibility to fill out the questionnaires, crossing of opinions of the compliance of the systems that did not coincide with the reality of the taxpayer, among others, it was necessary an extension in the term for the registration to such registry, since the taxpayers could not complete their registration in the initial term granted, according to the above mentioned decree in the third transitory article it is established as follows:
“Third. As of the date of entry into force of this Decree, individuals or legal entities that provide subcontracting services must obtain the registration before the Secretariat of Labor and Social Welfare provided for in Article 15 of the Federal Labor Law, no later than September 1, 2021.”
Remember that it is of utmost importance to have all the necessary documents for the registration to the registry at hand, such as:
- Valid electronic signature
- Proof of tax status
- Articles of Incorporation for legal entities
- Positive compliance opinion from SAT, IMSS, INFONAVIT, etc.
