Con la entrada en vigor de la reforma a la Ley Federal de Procedimiento Contencioso Administrativo publicada en el Diario Oficial de la Federación el 13 de junio del año en curso, se ponen en marchas distintas modalidades para el uso de la Firma Electrónica Avanzada y TLC Asociados las traduce para ti.

Debemos iniciar mencionando que la Firma Electrónica Avanzada, deberá ser tramitada por los demandantes que deseen substanciar el juicio de nulidad por la vía “Juicio en Línea”, para ello, el solicitante deberá obtener la mencionada Firma, Contraseña y Clave de acceso a través de Sistema de Justicia en Línea del Tribunal Fiscal.

Para las personas morales, la presentación de la demanda vía juicio en línea y cualquier otra promoción podrá realizarse, mediante la firma electrónica avanzada otorgada a dicha persona moral, o por su representante legal, en todo caso, cuando se registre la actuación y utilización de la firma electrónica de alguna persona moral, se entenderá que dicha actuación la realiza el Administrador único o el Presidente del Consejo de Administración.

La reforma también involucra al personal jurisdiccional del tribunal, ya que para emitir acuerdo, oficio o sentencias, estos deberán ser validados; según sea el caso, con la firma electrónica de los Magistrados, de los Secretarios de acuerdo y la firma electrónica del Actuario responsable de llevar a cabo la notificación.

Es de suma importancia señalar que los titulares de la Firma, Contraseña y Clave de acceso, son responsables de las actuaciones que se deriven de su utilización, ya que la firma electrónica, producirá los mismos efectos que una firma autógrafa.

With the entry into force of the Federal Law of the Contentious Administrative Procedure published in the Official Journal of the Federation on June 13th of this year, different modalities for the use of the Advanced Electronic Signature are launched, and TLC Asociados interprets them for you. 

We should start by mentioning that the Advanced Electronic Signature must be transmitted by the complaining parties that wish to substantiate the nullity trial by the “Online Trial” via, for this, the claimant must obtain the mentioned Signature, Password, and Access code through the “Online Justice System” of the Fiscal Tribunal.

For the legal entities, the submission of the lawsuit via online trial and any other promotion can be made, through the advanced electronic signature granted to such legal entity, or by the legal representative, in any case, when the action and use of the electronic signature of any legal entity is recorded, it will be understood that such action is carried out by the sole Administrator or by the President of the Board of Directors.

The reform also involves the jurisdictional personnel of the Tribunal, since to emit an agreement, official letter, or ruling, these will have to be validated, as the case may be, with the electronic signature of the Magistrates, the Secretaries, and the electronic signature of the Actuary responsible for making the notification.

It is very important to indicate that the holders of the Signature, Password and Access Code, are responsible for the actions that derive from its use because the electronic signature produces the same effects of an autograph signature.
