Enero: mes de dar aviso de modificación de transportistas autorizados OEA / January: Month to Notify Modification of Authorized AEO Carriers
Las empresas que cuentan con la certificación en el programa Operador Económico Autorizado deben designar a las empresas transportistas autorizadas para llevar a cabo sus movimientos de Comercio Exterior. Asimismo, cualquier cambio de adición o revocación debe ser notificado a la autoridad de acuerdo con las obligaciones del programa.
Esta notificación debe llevarse a cabo por medio del Aviso a que se refiere la regla 7.2.1., relacionados con el Registro en el Esquema de Certificación de Empresas, durante el mes siguiente de transcurrido el semestre en el que se realice el cambio.
Las Reglas Generales de Comercio Exterior establecen lo siguiente:
Dar aviso a la AGACE de la adición o revocación de empresas transportistas autorizadas para efectuar el traslado de las mercancías de comercio exterior, mediante el formato denominado “Avisos a que se refiere la regla 7.2.1., relacionados con el Registro en el Esquema de Certificación de Empresas” al mes siguiente de transcurrido el semestre. Para tal efecto, se considerarán como semestres los periodos comprendidos de enero a junio y de julio a diciembre de cada ejercicio fiscal.
Es decir, si dentro de los meses de junio a diciembre de 2020 se comenzó a realizar operaciones de comercio exterior con una empresa transportista que no se encuentre dada de alta ante la certificación OEA, o en su caso se termina relación comercial con alguna, se deberá presentar el aviso dentro del mes de enero de 2021. El aviso antes mencionado se debe presentar en Ciudad de México de manera presencial ante AGACE.
Es importante que las empresas que utilizan empresas subcontratadas para el traslado logístico de las mercancías de comercio exterior presenten los avisos correspondientes ante la autoridad en tiempo y forma con el objetivo de evitar caer en un supuesto de requerimiento, o en su caso, de cancelación de la certificación en el programa Operador Económico Autorizado, dejando sin efecto los beneficios que la misma ofrece.

Companies that are certified in the Authorized Economic Operator program must designate authorized transport companies to carry out their foreign trade movements. Also, any change of addition or revocation must be notified to the authority in accordance with the obligations of the program.
This notification must be carried out by means of the Notice referred to in rule 7.2.1., related to the Registration in the Company Certification Scheme, during the month following the end of the semester in which the change is made.
The General Rules of Foreign Trade establish the following:
Give notice to the AGACE of the addition or revocation of transport companies authorized to transfer foreign trade goods, by means of the format called “Notices referred to in rule 7.2.1., related to the Registration in the Company Certification Scheme”, during the month following the end of the semester in which the change is made. For such purpose, the periods from January to June and from July to December of each fiscal year shall be considered as semesters.
In other words, if within the months of June to December 2020, foreign trade operations began with a transportation company that is not registered with the AEO certification, or if the commercial relationship with any of them is terminated, the notice must be filed within the month of January 2021. The aforementioned notice must be filed in Mexico City in person before AGACE.
It is important that the companies that use subcontracted companies for the logistic transfer of foreign trade goods present the corresponding notices before the authority in due time and form in order to avoid falling into a situation of requirement, or in its case, of cancellation of the certification in the Authorized Economic Operator program, leaving without effect the benefits that it offers.
