Derivado de la reforma a la Ley Federal de Procedimiento Contencioso Administrativo publicada en el Diario Oficial de la Federación el 13 de junio del año en curso, se reformaron, adicionaron y derogaron diversas disposiciones, entre ellas las relativas al uso del correo electrónico como medio de comunicación entre Tribunal Federal de Justicia Fiscal y Administrativa y las partes del juicio.
Con la reforma citada, se establece como requisito indispensable al demandante, señalar en su escrito inicial de demanda, la dirección de correo electrónico y direcciones de correos electrónicos de personas autorizados para que las reciban en su nombre.
Del requisito anterior se derivan dos situaciones muy importantes, la primera es recibir las notificaciones que surjan en la tramitación del juicio, ya que estas deberán ser notificadas a través del “Boletín Jurisdiccional”; de no señalar la dirección de correo electrónico trae consigo la consecuencia de no recibir el aviso de anticipación, correspondiente a la publicación de las notificaciones en el boletín jurisdiccional.
No menos importante resulta mencionar que la Ley precisa que, cuando el demandante opte por substanciar el juicio por esta vía, indicará su dirección de correo electrónico; de ser omiso al señalar este requisito, el juicio deberá tramitarse por la “vía tradicional” y el Magistrado Instructor ordenará notificar el acuerdo correspondiente por lista y en el boletín procesal del Tribunal.
Asimismo de dicha reforma se establece el plazo de 3 meses contados a partir de la entrada envigo de la reforma, para que las autoridades registren ante la Secretaria de General de Acuerdos o ante la Presidencia de la Salas Regionales, su dirección de correo electrónico institucional, así como el domicilio oficial de las unidades administrativas a las que corresponda su representación.

Derived from the reform to the Federal Law of the Contentious Administrative Procedure published in the Official Journal of the Federation on June 13th of this year, different dispositions were reformed, added or repealed, among them the ones concerning the use of the email address as a form of communication between the Federal Tribunal of Fiscal and Administrative Justice and the parties of the trial.
With the mentioned reform, it is established as an essential requirement for the claimant to indicate in the initial written submission, the email address and addresses of the authorized persons to receive them in their representation.
From the previous requirement, two very important situations result, the first is to receive the notifications that arise from the process of the trial, since this will have to be notified through the “Jurisdictional Bulletin”; if and email address is not indicated then the consequence will be to not receive the advance notice that corresponds to the publication of the notifications in the jurisdictional bulletin.
Not less important is that the Law specifies that, when the claimant decides to substantiate the trial by this mean, they will indicate the email address; if they do not fulfill this requirement, the trial will have to be processed in the “traditional form” and the Examining Magistrate will order the notification of the corresponding agreement by list and in the procedural bulletin of the Tribunal.
Also, from such reform, a three-month term is established from its entry into force for the authorities to register in the General Secretary of Agreements or in the Presidency of the Regional Chambers, their institutional email address as well as the official address of the administrative units to which their representation corresponds.
