Conoce el horario de guardias del Tribunal Federal de Justicia Administrativa
Se podrán presentar escritos ante el Tribunal Federal de Justicia Administrativa:
- De 9:00 a las 15:00 horas
- Los días 15, 18, 19, 20, 21, 22, 26, 27, 28 y 29 de diciembre, todos de 2023, correspondientes al segundo periodo vacacional del Tribunal Federal de Justicia Administrativa, lo anterior en las Oficialías de Partes de las Salas del
Hay que recordar que el artículo 65 de la Ley Orgánica del Tribunal estatuye entre otras cuestiones:
- Regula los 2 periodos de vacaciones anuales, guardias, recepción de promociones y suplencia de presidentes del Tribunal Federal de Justicia Administrativa.
- Durante las vacaciones, se suspenderán las labores generales del Tribunal y no correrán los plazos.
- La Junta de Gobierno y Administración determinará el personal que deberá realizar guardias durante las vacaciones.
- Las promociones solo se recibirán en las horas hábiles que determine el Pleno General del Tribunal.
No obstante, el mismo artículo señala que:
- El personal de guardia atenderá y resolverá, en los casos urgentes que no admitan demora, las medidas cautelares y suspensión.
- Recepción de promociones:
- Únicamente se recibirán promociones en la oficialía de partes de cada Sala durante las horas hábiles.
Entonces, en caso de que algún acto o resolución administrativa, por sus características requiera de una atención inmediata para evitar que se produzcan daños o perjuicios irreparables al contribuyente en el ámbito del derecho se podrá presentar la demanda respectiva para proteger los derechos y evitar daños graves.
El concepto de caso urgente que no admite demora es importante porque permite que los tribunales protejan los derechos e intereses de las personas de forma oportuna, evitando que se produzcan daños irreversibles.
En el caso específico este artículo 65 de la Ley Orgánica del Tribunal Federal de Justicia Administrativa, habilita al Tribunal aun en periodo de vacaciones para resolver una medida cautelar o de suspensión de un acto administrativo de forma inmediata para evitar que se produzca un daño irreparable antes de que el Tribunal pueda resolver el fondo del asunto.
El citado horario se estableció en el ACUERDO SS/19/2023. HORARIO DE GUARDIAS EN LAS OFICIALÍAS DE PARTES DEL TRIBUNAL PARA EL SEGUNDO PERIODO VACACIONAL DEL AÑO 2023, publicado el 19 de diciembre de 2023.

- From 9:00 a.m. to 3:00 p.m.
- On December 15, 18, 19, 20, 21, 22, 26, 27, 28 and 29, 2023, corresponding to the second vacation period of the Federal Court of Administrative Justice, all of the above, at the Court’s Chambers’ Official Offices.
We should remember that Article 65 of the Organic Law of the Court stipulates, among other things, that:
- It regulates the 2 annual vacation periods, guards, reception of promotions and substitution of presidents of the Federal Court of Administrative Justice.
- During the vacations, the general work of the Court will be suspended and the deadlines will not apply.
- The Board of Governors and Administration will determine the personnel who will be required to perform on-call duties during vacations.
- The promotions will only be received during the business hours determined by the General Plenary of the Court.
However, the same article states that:
- The on-call personnel will deal with and resolve, in urgent cases that do not allow delay, precautionary measures and suspensions.
- Receiving promotions:
- Promotions will only be received at the official office of each courtroom during business hours.
Therefore, in the event that any administrative act or resolution, due to its characteristics, requires immediate attention to avoid irreparable damage or harm to the taxpayer, the respective lawsuit may be filed to protect the rights and avoid serious damage.
The concept of an urgent case that does not allow for delay is important because it allows the courts to protect the rights and interests of individuals in a timely manner, preventing irreversible damage from occurring.
In the specific case of this article 65 of the Organic Law of the Federal Court of Administrative Justice, it empowers the Court even in vacation period to resolve a precautionary measure or suspension of an administrative act immediately to avoid irreparable damage before the Court can resolve the case fundamentally.
