Competencia del verificador adscrito a la aduana para realizar el reconocimiento aduanero y levantar el acta en un PAMA
En marzo pasado, fue publicada en la Revista del Tribunal Federal de Justicia Administrativa, en su número 15, Novena Época, Año II, la tesis número IX-P-2aS-159, cuyo rubro señala: “PROCEDIMIENTO ADMINISTRATIVO EN MATERIA ADUANERA. EL VERIFICADOR ES COMPETENTE PARA REALIZAR EL RECONOCIMIENTO ADUANERO Y PARA PARTICIPAR EN EL LEVANTAMIENTO DEL ACTA DE INICIO.”
Mediante dicho criterio, el Tribunal Federal de Justicia Administrativa sostiene que de la interpretación sistemática de los artículos 21, apartado B, fracciones I y II y último párrafo, y 19, fracciones XLVI, LI, LIX, LXI, LXII, LXIII, LXVII, LXXIX y LXXX, numeral 9 del tercer párrafo, del Reglamento Interior del Servicio de Administración Tributaria publicado el 24 de agosto de 2015, se desprende que los verificadores son competentes para lo siguiente
1) Practicar el reconocimiento aduanero,
2) Dar a conocer a los contribuyentes los hechos u omisiones imputables a estos, conocidos con motivo del ejercicio de sus facultades de comprobación y hacer constar dichos hechos y omisiones en las actas u oficios que para tal efecto se levanten, en términos de la Ley Aduanera y demás disposiciones jurídicas aplicables,
3) Establecer la naturaleza, estado, origen y demás características de las mercancías de comercio exterior, así como sugerir su clasificación arancelaria,
4) Determinar, conforme a la Ley Aduanera, el valor en aduana y el valor comercial de las mercancías, y
5) Tramitar y registrar las importaciones o internaciones temporales de vehículos y verificar sus salidas y retornos.
Sigue mencionando que, no pasa inadvertida la tesis de jurisprudencia 2a./J. 118/2005, pues no es aplicable, porque de su ejecutoria se advierte que fue interpretado el Reglamento Interior del Servicio de Administración Tributaria vigente en 1999, el cual disponía que el reconocimiento aduanero debía practicarse directamente por el Administrador de la Aduana, mientras que el artículo 21, apartado B, fracción II, del Reglamento vigente prevé expresamente que los verificadores son competentes para practicar el reconocimiento aduanero, y sobre el particular, debe destacarse que en el acta de inicio de procedimiento administrativo en materia aduanera no debe fundarse la competencia del verificador, porque solo funge como un auxiliar, ya que el acta es emitida por el Administrador de la Aduana, la cual, incluso, debe examinarse en su integridad y estimarse debidamente justificada su actuación si antes de las firmas fue citada la referida fracción II del apartado B del artículo 21, pues desatender esa cita, porque no aparece en el apartado en que la autoridad funda comúnmente su competencia sería un formalismo excesivo.
Ahora bien, es cierto que, de conformidad con el anterior Reglamento Interior del Servicio de Administración Tributaria (24 de agosto de 2015), el verificador adscrito a una Aduana, es competente para realizar diversas facultades conferidas a la entonces Administración General de Aduanas (hoy Agencia Nacional de Aduanas de México) entre las que destacan practicar el reconocimiento aduanero de las mercancías y dar a conocer a los contribuyentes y demás actores de comercio exterior los hechos u omisiones imputables a ellos, conocidos con motivo del ejercicio de dichas facultades y hacerlos constar en actas o escritos que se levanten, sin embargo, en la practica sucede que dicho verificador es quien materialmente realiza la revisión de mercancías, pero era el Administrador o Subadministrador en aquel entonces, quien emitía el acta correspondiente, aunque podría ser firmada en suplencia por algún Jefe de Departamento, no obstante ello, se considera que si dicho verificador en algún momento levanta alguna actuación que sea firmada por el (acta de hechos) si deberá fundar su competencia para actuar, atentos a lo establecido por los artículos 14 y 16 Constitucionales, en relación con el diverso 38, fracción IV del Código Fiscal de la Federación, y así ha disdo interpretado por el propio Tribunal Federal de Justicia Administrativa.

Last March, it was published in the Federal Court of Administrative Justice Magazine, in its number 15, Ninth Epoch, Year II, the thesis number IX-P-2aS-159, whose heading states: “ADMINISTRATIVE PROCEDURE IN CUSTOMS MATTERS. THE VERIFIER IS COMPETENT TO CARRY OUT THE CUSTOMS EXAMINATION AND TO PARTICIPATE IN THE PREPARATION OF THE INITIATION ACT.”
By means of this criterion, the Federal Court of Administrative Justice holds that from the systematic interpretation of articles 21, paragraph B, sections I and II and last paragraph, and 19, sections XLVI, LI, LIX, LXI, LXII, LXIII, LXVII, LXXIX and LXXX, item 9 of the third paragraph, of the Internal Regulations of the Tax Administration Service published on August 24, 2015, it is evident that the verifiers are competent for the following:
1) Performing customs examination,
2) Inform taxpayers of the facts or omissions attributable to them, known as a result of the exercise of their verification powers, and record such facts and omissions in the reports or official documents issued for such purpose, in terms of the Customs Law and other applicable legal provisions,
3) Establish the nature, condition, origin and other characteristics of foreign trade goods, as well as suggest their tariff classification,
4) Determine, in accordance with the Customs Law, the customs value and commercial value of goods, and
5) Process and register temporary imports or international imports of vehicles and verify their departure and return.
It also mentions the fact that the jurisprudence thesis 2a./J. 118/2005 does not go unnoticed, since it is not applicable, because from its decision it is noted that the Internal Regulations of the Tax Administration Service in force in 1999 were interpreted, which provided that the customs examination should be performed directly by the Customs Administrator, while article 21, paragraph B, section II, of the current Regulations expressly provides that the verifiers are competent to perform the customs examination, and in this regard, it must be emphasized that the act of initiation of the administrative procedure in customs matters should not be based on the competence of the verifier, because he/she only acts as an auxiliary, since the act is issued by the Customs Administrator, which must be examined in its entirety and his/her actions must be considered duly justified if before the signatures the referred section II of paragraph B of article 21 was quoted, since ignoring this quote, because it does not appear in the section in which the authority commonly bases its competence would be an excessive formalism.
Now, it is true that, in accordance with the previous Internal Regulations of the Tax Administration Service (August 24, 2015), the verifier assigned to a Customs, is competent to perform various powers conferred to the then General Customs Administration (now the National Customs Agency of Mexico), among which we can highlight the practice of customs examination of goods and inform taxpayers and other parties of foreign trade of the facts or omissions attributable to them, known on the occasion of the exercise of such powers and record them in minutes or written documents that are raised, however, in practice it happens that this verifier is the one who materially performs the review of merchandise, but it was the Administrator or Deputy Administrator at that time, who issued the corresponding act, although it could be signed in substitution by a Department Head, notwithstanding this, it is considered that if this verifier at some point in time, attains any action that is signed by this person (act of facts), he/she must justify his/her competence to act, in accordance with the provisions of articles 14 and 16 of the Constitution, in relation to article 38, section IV of the Federal Tax Code, and this has been interpreted by the Federal Court of Administrative Justice.
