Cancellation of antidumping duties imposed on the imports multilayer paper bags and cement from Brazil
TLC Asociados makes of your knowledge the publication in the Official Journal of the Federation on December 15th, 2016 in regards to the Final RESOLUTION of the antidumping duties imposed on the imports of multilayer paper bags for lime and cement from the Federative Republic of Brazil, independently of its country of provenance´s validity examination, emphasizing and concluding the following:
- Background. On January 25th, 2006, it was published in the Official Journal of the Federation (DOF) the Final Resolution of the antidumping investigation on the imports of multilayer paper bags for lime and cement originating from Brazil. Through this Resolution the Secretariat determined to impose the following final antidumping duties:
a) of 19.33% for the imports from the company Trombini Embalagens, Ltda (“Trombini”), and
b) of 29.11% for the imports from the company Klabin, S.A. (“Klabin”) and for the other exporting companies.
On July 16th, 2012, it was published in the DOF the Final Resolution of the first validity examination and of the ex officio review of the antidumping duties. It was decided to maintain them for five more years.
- Claims. On December 2nd, 2015 Bio Pappel, S.A.B. de C.V. (“Bio Pappel”) manifested its interest to have the Secretariat start a validity examination of the antidumping duties.
- Publication in the DOF of the investigation´s initiation. On January 8th, 2016, the Resolution that declared the initiation of the antidumping duty´s validity examination was published on the DOF.
- Product object of the investigation. The products object of the examination are the bags for lime and three-layered bags for cement. They are flexible packaging elaborated with many paper layers and other materials.
- Tariff codes. It enters by the tariff code 4819.30.01 of the TIGIE.
- Conclusions. The Secretariat concluded that there are not enough elements to determine that the elimination of the antidumping duties imposed on the imports of bags for lime and three-layered bags for cement from Brazil will give place to the repetition of the disloyal practice, therefore they are eliminated.
- Resolution, The antidumping duties imposed on multilayer paper bags and cement from Brazil are eliminated.
- Entry into force. December 16th, 2016.
