El 24 de julio de 2020 se dio a conocer en el Diario Oficial de la Federación la “Primera Resolución de Modificaciones a las Reglas Generales de Comercio Exterior para 2020”, misma que tendrá vigencia el 27 de julio del presente, con excepción de los transitorios.

El régimen de depósito fiscal consiste en el almacenamiento de mercancías de procedencia extranjera o nacional en almacenes generales de depósito que puedan prestar este servicio en los términos de la Ley General de Organizaciones y Actividades Auxiliares del Crédito y además sean autorizados para ello, por las autoridades aduaneras. Artículo 119 LA.

En relación con el RECE modalidad del Socio Comercial Certificado, se adicionó el rubro Almacén General de Depósito, misma que se indican a continuación:

I. Requisitos que deberán cumplir los interesados en obtener la modalidad de SCC.

1. Regla 7.1.5 de las RGCE para 2020.
2. Se adiciona la fracción VII para incorporar al rubro de “Almacén General de Depósito” con excepción de los supuestos VIII, X, XI y XIV de la regla 7.1.1 de las RGCE.
3. Cumplir con los requisitos generales del registro de esquema de certificación de empresas, excepto.
4. Presentar la solicitud electrónica a través de la ventanilla digital.
5. Contar con autorización vigente para prestar el servicio de almacenamiento de mercancías en régimen de depósito fiscal.
6. Presentar el formato denominado “Perfil del Almacén General de Depósito” del Anexo 1 por cada local, instalación, bodega o sucursal que el almacén general de depósito determine que forme parte de su registro.
7. Haber prestado el servicio de almacenamiento de mercancías bajo el régimen de depósito fiscal, por lo menos 2 años previos a la presentación de la solicitud.

II. Obligaciones en el RECE modalidad Socio Comercial Certificado.

1. Regla 7.2.1 de las RGCE para 2020.
2. En el párrafo 4, fracción I, se adiciona la obligación de avisar sobre las modificaciones del “Perfil del Almacén General de Depósito” mediante avisos a la AGACE a través de la Ventanilla Digital, dentro del mes siguiente.

Adicionalmente, deberá presentar el “Perfil del Almacén General de Depósito” en los 3 meses siguientes de dar el aviso apertura de nuevas instalaciones, debidamente llenado y en medio magnético, cumpliendo con los estándares mínimos en materia de seguridad en la nueva instalación.

También es necesario dar aviso dentro del mes siguiente de realizada la modificación, cuando las circunstancias por las cuales se les otorgó el registro hayan variado y derivado de éstas se requieran cambios o modificaciones en la información vertida y proporcionada a la autoridad, llenando el formato “Perfil del Almacén General de Depósito”.

3. En el párrafo 4, fracción II, se adiciona la obligación de avisar sobre la apertura de nuevas instalaciones o la baja de las instalaciones reportadas relacionadas con el “Perfil del Almacén General de Depósito”.
4. En el párrafo 4, fracción VII, se adiciona la referencia de la obligación de cumplir permanentemente con el “Perfil del Almacén General de Depósito”.

III. Causales de cancelación y suspensión del RECE en las modalidades de IVA e IEPS y SCC.

1. Regla 7.2.4 de las RGCE para 2020.
2. En el apartado C, en la fracción VI, se adiciona la causal a quienes dejen de cumplir con el “Perfil del Almacén General de Depósito” del Anexo 1.
3. En el apartado C, en la fracción VII, se adiciona la causal cuando la autorización para prestar el servicio de almacenamiento de mercancías en régimen de depósito fiscal sea cancelada definitivamente.

III. Beneficios del RECE en la modalidad de SCC, rubro Transportista Ferroviario, Parque Industrial, Recintos Fiscalizados, Mensajería y Paquetería y Almacén General de Depósito.

1. Regla 7.3.10 de las RGCE para 2020.
2. Se incorpora el beneficio de publicitar previa autorización en el portal del SAT al Socio Comercial Certificado del rubro Almacén General de Depósito para efectos de compartirlo con las empresas de otros rubros que requieran dichos servicios.

Sin duda, los Almacenes Generales de Depósitos tendrán una alternativa para participar de manera segura en la cadena de suministro como Socio Comercial Certificado y con ello sumar esfuerzos con los demás operadores económicos autorizados.

On July 24, 2020, the “First Resolution of Amendments of the General Rules of Foreign Trade for 2020” was published in the Official Journal of the Federation, which came into force on July 27^th of this year, except for the transitory articles.

The bonded warehouse regime consists of the storage of foreign or national good in general warehouses that can provide this service in terms of the General Law of Organizations and Auxiliary Credit Activities, and in addition they are authorized for it by the custom authorities. Article 119 of the Customs Law.

As for the RECE (Registration in the Company Certification Scheme) in the modality of Certified Business Partner (SCC), the section of General Warehouse was added, which is presented below:

I. Requirements for those interested in the SCC modality.

1. Rule 7.1.5 from the General Rules of Foreign Trade (RGCE) for 2020.
2. Section VII is added to incorporate the heading ” General Warehouse” except for cases VIII, X, XI and XIV of rule 7.1.1 of the RGCE.
3. Comply with the general requirements for the registration in the company certification scheme, except.
4. Submit the electronic application through the digital window.
5. Hold current authorization to provide the service of storage of goods under the bonded warehouse regime.
6. Submit the “General Warehouse Profile” form in Annex 1 for each location, facility, warehouse or branch that the general warehouse determines to be part of its registration.
7. Have provided the service of storage of goods under the bonded warehouse regime, at least 2 years prior to the submission of the application.

II. Obligations in the RECE, Certified Business Partner modality.

1. Rule 7.2.1 from the RGCE for 2020.
2. In paragraph 4, section I, the obligation was added to notify about the modifications made to the “General Warehouse Profile” though notices to the AGACE using the Digital Window within the following month.

In addition, the “General Warehouse Profile” must be submitted withing the 3 months after giving notice of the new facilities, duly filled and in magnetic medium, meeting the minimum safety standards in the new facility.

It is also necessary to give notice within the month following the modification, when the circumstances for which they were granted the registration have changed and derived from these changes or modifications are required in the information poured and provided to the authority, filling out the form “General Warehouse Profile”.

3. In paragraph 4, section II, the obligation to notify the opening of new facilities or the cancellation of reported facilities related to the “General Warehouse Profile” is added.
4. In paragraph 4, section VII, the reference to the obligation to comply permanently with the “General Warehouse Profile” is added.

III. Causes for cancellation and suspension of the RECE in the VAT and STPS and SCC modalities.

1. Rule 7.2.4 from the RGCE for 2020.
2. In section C, fraction VI, the cause is added to those who no longer comply with the “General Warehouse Profile ” of Annex 1.
3. In section C, fraction VII, the grounds are added in the event that the authorization to provide the service of storage of goods under the bonded warehousing system is definitively cancelled.

III. Benefits of the RECE in the modality of SCC, item Railroad Transporter, Industrial Park, Bonded Warehouses, Courier and Parcel Service and General Warehouse.

1. Rule 7.3.10 from the RGCE for 2020.
2. The benefit of advertising on the SAT portal is incorporated to the Certified Business Partner of the General Warehouse category for the purpose of sharing it with companies in other categories that require such services.

Undoubtedly, General Warehouses will have an alternative to participate safely in the supply chain as a Certified Business Partner and thus join efforts with the other authorized economic operators.
