El 27 de diciembre de 2020 fue publicada en el DOF la “Acuerdo que modifica al diverso por el que la Secretaría de Economía emite Reglas y Criterios de Carácter General en materia de Comercio Exterior”, la cual tendrá vigencia el 28 de diciembre de 2020, con excepción de los transitorios.

En este apartado se identificarán las principales adiciones y reformas, mismas que se indican a continuación:

I. Cambios de las disposiciones generales

1) Son reformadas 26 reglas, adicionado 1 capítulo y 1 anexo, son reformados 4 Anexos, y se derogan fracciones de 2 Anexos.

2) En términos generales en las disposiciones se introduce el elemento del NICO en las referencias de la clasificación arancelaria o citas de fracciones arancelarias.

3) Algunas reglas hacen referencia al nuevo Tratado entre México, Estados Unidos y Canadá.

4) También, se realizan algunas precisiones de redacción para hacerlas comprensibles.

II. Reformas de las reglas específicas

1) la regla 1.2.1;

• Se actualizan los conceptos y acrónimo para quedar 65 términos. Por ejemplo: se modifica ASERCA-SADER, DGFCCE, T-MEC. Por otro lado, es eliminado el APO relacionado con las cuotas compensatorias.

2) el primer párrafo de la regla 1.3.1;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.

3) el primer párrafo de la regla 1.3.6;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.

4) el primer párrafo de la regla 1.3.7;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.

5) el primero párrafo de la regla 1.3.8;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.

6) la regla 1.4.1,

• Se modifica para hacer referencia al portal del SNICE snice.gob.mx, y dejar de mencionar https://www.gob.mx/se.

7) el encabezado del tercer párrafo de la regla 2.2.3;

• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 relacionadas con el programa de cadenas globales de proveeduría ante la DGIPAT.

8) las fracciones I, II y IV de la regla 2.2.4;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.
• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 relacionadas con los tipos permisos previos mencionados.
• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

9) primero, segundo y tercer párrafos de la regla 2.2.6;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).
• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal. 

10) la regla 2.2.8;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

11) segundo y tercer párrafos de la regla 2.2.11;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

12) el encabezado del primer párrafo y segundo párrafo de la regla 2.3.5;

• Se modifica para hacer referencia a la Oficina de Representación, y dejar de mencionar Representación Federal.

13) la regla 2.4.2;

• Se actualizan las referencias de los artículos 64 y 145 de la Ley de la Infraestructura de la Calidad, y deja mencionar la LFMN, y mantiene la condicionante de que el país de origen es indicativo en el documento que cumple con la NOM.

14) segundo y cuarto párrafos de la regla 2.6.6;

• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.

15) el encabezado del primer párrafo de la regla 3.2.16;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

16) primero y tercer párrafos de la regla 3.2.26;

• Se actualizan las referencias de los artículos 4.2 y 4.4 del T-MEC, y dejan de mencionar al TLCAN.

17) segundo párrafo de la regla 3.3.3;

• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.

18) segundo párrafo de la regla 3.3.6;

• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.

19) encabezado del primer párrafo de la regla 3.4.10;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

20) primer párrafo de la regla 3.4.11;

• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.

21) tercero, séptimo, octavo y noveno párrafos de la fracción II de la regla 3.4.13;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

22) el encabezado del primer párrafo y el numeral 3 de la fracción II del cuarto párrafo de la regla 3.5.1;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).
• Se actualizan las referencias del T-MEC, y dejan de mencionar al TLCAN.

23) el primer párrafo de la regla 3.5.2;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

24) el encabezado del primer párrafo de la regla 3.7.1;

• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).
• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 relacionadas con las autorizaciones mencionadas.

25) el segundo párrafo del subinciso ii, los subincisos v y vi del inciso a) y el encabezado del primer párrafo del subinciso b) de la fracción II del numeral 1 del apartado A y segundo párrafo del numeral 3 del apartado B de la regla 5.3.1;

• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 relacionadas con las autorizaciones mencionadas.
• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.
• Se actualiza la referencia de ASERCA-SADER, y deja de mencionar ASERCA-SAGARPA.

26) inciso a) de la fracción I del numeral 1, el subinciso ii del inciso a) de la fracción III del numeral 2, y segundo, tercer y cuarto párrafos del numeral 6 de la regla 5.7.1;

• Se actualiza para referir a la importación temporal y dejar de mencionar régimen temporal.
• Se modifica para hacer referencia a la Oficina de Representación, y dejan de mencionar Representación Federal.
• Es actualizada la referencia de la DGFCCE (Dirección General de Facilitación Comercial y de Comercio Exterior), antes mencionaba a la DGCE (Dirección General de Comercio Exterior).

II. Actualización de los Anexos

1) Anexo 2.2.1. Clasificación y codificación de mercancías cuya importación y exportación está sujeta al requisito de permiso previo o aviso automático por parte de la Secretaría de Economía

• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 y sus NICO relacionadas con las autorizaciones de los permisos y avisos mencionados.

2) Anexo 2.2.2 Criterios y requisitos para otorgar los permisos previos y avisos automáticos

• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 y sus NICO relacionadas con las autorizaciones de los permisos y avisos mencionados.

3) ANEXO 2.4.1 Fracciones arancelarias de la Tarifa de la Ley de los Impuestos Generales de Importación y de Exportación en las que se clasifican las mercancías sujetas al  cumplimiento de las Normas Oficiales Mexicanas en el punto de su entrada al país,  y en el de su salida (Anexo de NOM’S)

• Son actualizadas las fracciones arancelarias de la nueva LIGIE 2020 y sus NICO relacionadas con las NOM mencionadas.

4) Anexo 3.5.1 Tabla de llenado, solicitudes Drawback.

• Se actualizan las referencias del T-MEC, y dejan de mencionar al TLCAN.

On December 28, 2020 was published in the DOF the “Agreement that modifies the article by which the Secretariat of Economy issues the Rules and Criteria of General Character in matters of Foreign Trade“, which will be in force on December 28, 2020, except for the transitory ones.

Here we will identify the main additions and amendments, which are listed below:

I. Changes to General Provisions

1) 26 rules are amended, 1 chapter and 1 annex are added, 4 annexes are amended, and fractions of 2 annexes are repealed.

2) In general terms, the provisions introduce the NICO element in the references of the tariff classification or quotations of tariff items.

3) Some rules refer to the new Agreement between Mexico, United States and Canada.

4) Also, some drafting clarifications are made to make them understandable.

II. Amendments to the specific rules

1) Rule 1.2.1;

• The concepts and acronym are updated to 65 terms. For example: ASERCA-SADER, DGFCCE, USMCA are modified. On the other hand, the APO related to countervailing duties is eliminated.

2) First paragraph of Rule 1.3.1;

• Amended to refer to the Representative Office, and no longer mentions Federal Representation.

3) First paragraph of Rule 1.3.6;

• Amended to refer to the Representative Office, and no longer mentions Federal Representation.

4) First paragraph of Rule 1.3.7;

• Amended to refer to the Representative Office, and no longer mentions Federal Representation.

5) First paragraph of Rule 1.3.8;

• Amended to refer to the Representative Office, and no longer mentions Federal Representation.

6) Rule 1.4.1,

• It is modified to refer to the SNICE portal www.snice.gob.mx, and no longer refers to https://www.gob.mx/se.

7) The heading of the third paragraph of the rule 2.2.3;

• The tariff fractions of the new LIGIE 2020 related to the global supply chain program are updated before the DGIPAT.

8) Sections I, II and IV of rule 2.2.4;

• It is modified to refer to the Representative Office, and no longer to mention Federal Representation.
• The tariff fractions of the new LIGIE 2020 related to the previously mentioned types of permits are updated.
• The reference to the DGFCCE (General Office for Trade Facilitation and Foreign Trade), which previously mentioned the DGCE (General Office for Foreign Trade), is updated.

9) First, second and third paragraphs of the rule 2.2.6;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously named the DGCE (General Office for Foreign Trade), is updated.
• It is modified to refer to the Office of Representation, and no longer mentions Federal Representation.

10) Rule 2.2.8;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously named the DGCE (General Office for Foreign Trade), is updated.

11) Second and third paragraphs of rule 2.2.11;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously named the DGCE (General Office for Foreign Trade), is updated.

12) The heading of the first paragraph and second paragraph of rule 2.3.5;

• Amended to refer to the Representative Office, and no longer mentions Federal Representation.

13) Rule 2.4.2;

20) First paragraph of rule 3.4.11;

• It is modified to refer to the Office of Representation, and no longer mentions Federal Representation.

21) Third, seventh, eighth and ninth paragraphs of section II of rule 3.4.13;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously mentioned to the DGCE (General Office for Foreign Trade), is updated.

22) The heading of the first paragraph and paragraph 3 of section II of the fourth paragraph of rule 3.5.1;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously mentioned to the DGCE (General Office for Foreign Trade), is updated.
• The references of the USMCA are updated, and they stop mentioning NAFTA.

23) First paragraph of rule 3.5.2;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously mentioned to the DGCE (General Office for Foreign Trade), is updated.

24) The heading of the first paragraph of rule 3.7.1;

• The reference of the DGFCCE (General Office for Trade Facilitation and Foreign Trade), previously mentioned to the DGCE (General Office for Foreign Trade), is updated
• The tariff sections of the new LIGIE 2020 related to the above mentioned authorizations are updated.

25) The second paragraph of sub-article ii, sub-items v and vi of paragraph a) and the heading of the first paragraph of sub-article b) of section II of paragraph 1 of section A and the second paragraph of paragraph 3 of section B of rule 5.3.1;

• The tariff sections of the new LIGIE 2020 related to the above mentioned authorizations are updated.
• It is modified to refer to the Representative Office, and no longer mentions Federal Representation.
• The reference to ASERCA-SADER is updated, and it stops mentioning ASERCA-SAGARPA.

26) Sub-paragraph a) of section I of numeral 1, sub-paragraph ii of section a) of numeral III of numeral 2, and second, third and fourth paragraphs of numeral 6 of rule 5.7.1;

• It is updated to refer to temporary import and no longer mention temporary regime.
• It is modified to refer to the Representative Office, and no longer mentions Federal Representation.
• The reference to the DGFCCE (General Office for Trade Facilitation and Foreign Trade) is updated, it previously mentioned the DGCE (General Office for Foreign Trade).

II. Annex Updates

1) Annex 2.2.1. Classification and codification of goods whose import and export is subject to the requirement of prior permission or automatic notification by the Secretariat of Economy

• The tariff fractions of the new LIGIE 2020 and its NICOs related to the authorizations of the mentioned permits and notices are updated.

2) Annex 2.2.2 Criteria and Requirements for Granting Pre-Permits and Automatic Notices

• The tariff fractions of the new LIGIE 2020 and its NICOs related to the authorizations of the mentioned permits and notices are updated.

3) ANNEX 2.4.1 Tariff fractions of the Tariff of the General Import and Export Tax Law in which the goods subject to compliance with the Official Mexican Standards are classified at the point of their entry into the country, and at the point of their exit (NOM’S Annex)

• The tariff fractions of the new LIGIE 2020 and its NICOs related to the mentioned NOMs are updated.

4) Annex 3.5.1 Filling Table, Drawback Applications.

• USMCA mentions are updated, and no longer mention NAFTA.
