398 – Agiliza carril FAST exportaciones de las empresas./ Fast Lane streamlines companies’ exportations
El programa voluntario C-TPAT (Customs Trade Partnership Against Terrorism) tiene como objetivo construir relaciones de cooperación comercial que refuercen y mejoren la cadena de valor empresarial, así como la seguridad en la frontera de los Estados Unidos de América (EUA). Por lo anterior se otorgan beneficios a las empresas que sean parte de este programa, siendo uno de los beneficios más atractivos el Acceso al carril FAST, el cual busca reducir el número de inspecciones en Aduana y agilizar las exportaciones.
Para hacer uso del carril FAST se deben cumplir las siguientes características al momento de realizar una exportación:
- Debe ser un operador que transporta mercancía de un importador certificado en C-TPAT a través de una empresa transportista certificada C-TPAT. El manufacturero también debe ser miembro certificado del programa C-TPAT.
- Cumplir con todas las leyes de aduanas e inmigración, y cualquier otra ley cuya verificación de cumplimiento está bajo la autoridad de la Customs and Border Protection, por sus siglas CBP.
- Portar credencial de operador comercial FAST, identificación oficial o documentación necesaria de inmigración.
La certificación C-TPAT no es transferible entre empresas afiliadas ubicadas en ambos lados de la frontera, porque cada entidad debe someter su solicitud independientemente.
Cuando se obtenga un nuevo importador u otro socio comercial, se deberá confirmar el estatus en el portal, de no estar autorizados deberán utilizar carriles normales.
De acuerdo a información recibida en días pasados por parte de especialistas de la CBP, se tiene conocimiento de empresas que han abusado del beneficio, con y sin éxito, sin cumplir con los requisitos establecidos, por lo que se corre el riesgo de recibir sanciones.
Las empresas que tengan movimientos hacia EUA e intenten utilizar el carril FAST sin cumplir con los requisitos podrán ser acreedores a lo siguiente:
- En caso de incumplir o violar alguna condición del Programa FAST será acreedor de una sanción directamente con las autoridades.
- La credencial FAST del transportista será revocada y deberá esperar 90 días para poder aplicar nuevamente.

The voluntary C-TPAT (Customs Trade Partnership Against Terrorism) program aims to build commercial cooperation relationships that reinforce and improve the business value chain, as well as border security in the United States of America (USA). Therefore, benefits are granted to companies that are part of this program, one of the most attractive benefits being the access to the FAST lane, which seeks to reduce the number of Customs inspections and expedite exports.
To use the FAST lane, the following characteristics must be met when conducting an export operation:
- Must be an operator that transports merchandise from a certified importer in C-TPAT through a certified C-TPAT transport company. The manufacturer must also be a certified member of the C-TPAT program.
- Comply with all customs and immigration laws, and any other law whose verification of compliance is under the authority of the Customs and Border Protection, for its acronym CBP.
- Carry a FAST-commercial operator credential, official identification or necessary immigration documentation.
The C-TPAT certification is not transferable between affiliated companies located on both sides of the border, because each entity must submit their application independently.
When a new importer or other commercial partner is attained, the status in the portal must be confirmed, if they’re not authorized they must use normal lanes.
According to information received in recent days by CBP specialists, there is knowledge of companies that have abused this benefit, with and without success, without complying with the established requirements, so there’s a risk of penalties.
Companies with transportation towards the US that try to use the FAST lane without complying with the requirements may be entitled to the following:
- In case of failure to comply with or violate any condition of the FAST Program, will be liable to a penalty directly from the authorities.
- The carrier’s FAST credential will be revoked, and you must wait 90 days to apply again.
