Vulnerable Activities, Construction Services, and Real Estate Development.

It is made of your knowledge that the RESOLUTION that modifies the other by which the official formats of the notices and reports that those who carry out vulnerable operations must submit was published in the Official Journal of the Federation on December 16th, 2016, where article 3, letter g) is reformed; Annex “5” is reformed in its name, to become Annex “5-A”; and Annex “5-B” is added to the Resolution by which the official formats of the notices and reports that those who carry out vulnerable operations must submit.

This modification mainly refers to those vulnerable activities indicated in the letter V, of the article 17 of the Federal Law for the Prevention and Identification of Operations with Illegally Obtained Resources concerning the services of construction or real estate development, with the intermediation in the transfer of property ownership or with the constitution of rights over such properties, taking into consideration the “Annex 5-A”, and the related with real estate developing according to the Annex “5-B”.

For the purposes of Annex “5-B”, real estate development will be those works that consist on real estate developments or division of plots, where vulnerable operations of selling and buying real estate are involved.

It is worth noting that in the publication, the specific fields in regards to the new Annex “5-B” are indicated for the consideration of those taxpayers that are obligated to comply them.
