“PEDIMENTO ÚNICO. HASTA NUEVO AVISO” / “UNIQUE CUSTOMS DECLARATION. UNTIL FURTHER NOTICE”

TLC Asociados comparte con ustedes las actualizaciones que se han venido realizando en estas últimas semanas respecto de la obligación citada para las empresas certificadas en materia de IVA e IEPS de conformidad con lo establecido en la regla 7.2.1 fracción V de las Reglas Generales de Comercio Exterior para 2016, relacionado con el PEDIMENTO ÚNICO.
Inicialmente, se hizo la publicación por parte del Servicio de Administración Tributaria del Boletín P043 de fecha 21 de Junio de 2016 mediante el cual se indica, el procedimiento que debían seguir los contribuyentes para generar el pedimento único virtual.
Sin embargo, el día 29 de Junio de 2016 se realizó la publicación del Boletín P047 señalando que la obligación del Pedimento Único NO SERA EXIGIBLE HASTA NUEVO AVISO.
Asimismo se indicó, que las empresas que cuenten con la certificación en materia de IVA e IEPS de conformidad con la Reglas de Carácter General en Materia de Comercio Exterior para 2013 y 2014 y la Reglas Generales de Comercio Exterior para 2015 y 2016, anteriores a la entrada en vigor del Capítulo 7 de la Primera Resolución de Modificaciones a las Reglas Generales de Comercio Exterior para 2016, no se encuentran sujetas a dicha obligación.
Finalmente se señala, que la opción de realizar el pedimento único sigue siendo válida para aquellas empresas que así lo consideren realizar pero es únicamente OPCIONAL. Consulta con los expertos de TLC Asociados la forma correcta de realizar tu pedimento único virtual en caso de así requerirse.

TLC Asociados shares with you the updates that have been done in these lasts weeks in regards to the obligation stated for the VAT and STPS certified companies according to the established in the rule 7.2.1. section V of the General Rules of Foreign Trade for 2016, related to the UNIQUE CUSTOMS DECLARATION.
Initially, the Tax Administration Service published its Bulletin P043 on June 21st, 2016, where it indicated the procedure that the taxpayers must follow to generate a unique virtual customs declaration.
However, on June 29th, 2016, the Bulletin P047 was published where it is indicated that the obligation of the Unique Customs Declaration WILL NOT BE ENFORCEABLE UNTIL FURTHER NOTICE.
Also, it was indicated that the companies that have the certification in the VAT and STPS matter in accordance with the General Character Rules of Foreign Trade for 2013 and 2014, and the General Rules of Foreign Trade for 2015 and 2016, before the Chapter 7 of the First Resolution of Modification to the General Rules of Foreign Trade for 2016 took effect, are not subjected to such obligation.
Finally, it is indicated that the option to make a unique customs declaration is still valid to those companies that consider doing it, but it is only OPTIONAL. Consult with the experts of TLC Asociados the correct form of doing your virtual customs declaration in case of requiring it so.
