Transportista Certifícate en OEA,a partir del 10 de Marzo de 2017 no podrás utilizar los carriles Fast
Una frase que se escuchará constantemente a partir del 10 de marzo del 2017 será – “dile al cliente que nos espere, como sea llegamos, dile que tuvimos un “problemita”.
Los carriles Fast y Express son resultado del trabajo conjunto entre los gobiernos de México y Estados Unidos, los cuales permiten a las empresas importadoras y exportadoras certificadas realizar un cruce fronterizo más rápido y con un menor número de inspecciones.
Para las empresas certificadas, los carriles FAST son un beneficio sustancial debido a que los embarques son considerados de bajo riesgo, lo cual reduce los tiempos en aduana y los porcentajes en el número de inspecciones, por lo que, el tiempo de su trayecto al saltarse grandes filas es menor y les genera mayores cruces al día.
El carril FAST actualmente, solo puede ser utilizado bajo el debido cumplimiento de 3 requerimientos;
- Empresa Manufacturera certificada
- Transportista Certificado
- Operador de transporte con credencial FAST
El trasladando la mercancía de una empresa manufacturera miembro del programa debe realizarse por medio de una empresa transportista certificada C-TPAT y el operador deberá contar con su credencial de operador comercial FAST para el traslado de la mercancía.
El pasado 09 de Mayo se publicaron las nuevas reglas de Comercio Exterior, las cuales entraron en vigor el 20 de junio del presente año, derogando las reglas 3.8.1 y 3.8.15 correspondientes a NEEC y Socio Comercial certificado respectivamente, se adiciona el capítulo 7 para empresas certificadas y socio comercial certificado, donde se agrega a los transportista ferroviarios, parques Industriales, Recintos Fiscalizados, empresas de Paquetería y mensajería dentro del esquema del Operador Económico Autorizado.
Referente al uso del carril exclusivo FAST, en la publicación de las Reglas de Comercio Exterior párrafo vigésimo segundo, establece lo siguiente en relación a las empresas transportistas:
- Las empresas transportistas que a la fecha de la publicación de la presente Resolución, no cuenten con la certificación como Socio Comercial Certificado OEA, no podrán seguir utilizando los carriles exclusivos “FAST”, por un plazo de 10 meses, contados a partir de la publicación de 09 de mayo de 2016, e incluso por el periodo en que se resuelva su solicitud de Registro en el Esquema de Certificación de Empresas, siempre y cuando dicha solicitud se presente dentro de los 10 meses señalados.
Por lo anterior Las empresas transportistas que hayan presentado la solicitud de inscripción como social comercial certificado OEA, pero que al 10 de marzo de 2017 no hayan recibido una respuesta a su solicitud, podrán usar el carril FAST, hasta que su solicitud sea resuelta por parte de la autoridad.
Con la entrada en vigor de las nuevas reglas de comercio exterior, las empresas que no se encuentren bajo los dos esquemas se seguridad, C-TPAT y Operador Económico Autorizado y/o en el caso de los transportistas, bajo la modalidad de Socio Comercial Certificado, cuentan con cada vez menos meses para seguir utilizando el beneficio de este carril.
La solución para que estas empresas mantengan el nivel de calidad de servicio y entregas será que dispongan de recursos humanos y materiales para obtener esta certificación de socio comercial, trámite que se realiza ante el Servicio de Administración Tributaria.
Facilidades para los transportistas que soliciten la certificación como socio comercial certificado
- Las empresas transportistas que cuenten con instalaciones que hayan sido validadas por C-TPAT dentro de los últimos tres años, no estarán obligadas a llenar el formato “Perfil del Auto Transportista Terrestre” de dicha instalación.
- Para acreditar la validación realizada por C-TPAT, deberán anexar el reporte de validación y autorizar en su portal el compartir información con México.
- Las instalaciones que acrediten debidamente esta facilidad, adicionalmente será reconocida la validación realizada por C-TPAT, por lo que no se realizará la visita inicial por parte del OEA de México.
La Directora Daniella Martínez Rodríguez y la Líder Anahi Peralta Pérez de la División de Certificaciones NEEC/(OEA)/CTPAT de TLC asociados, recomiendan que en caso de buscar asesores identifiquen que cuentan con experiencia en logística, operación aduanera, desarrollo de procesos, análisis de riesgo y seguridad aduanera, preferentemente que estén certificados como auditores líderes en ISO28000, y por supuesto, que en caso de que les propongan entregarles machotes de procedimientos, mejor busquen otra opción, ya que, cada operación logística aun siendo del mismo sector tiene diferentes vulnerabilidades, no se trata tan solo de un caja, tractor, llantas, gasolina y aceite, en estos esquemas un error hace vulnerable su negocio, el prestigio y confianza ante las autoridades.
Por lo anteriormente expuesto, se les invita hacer extensiva la invitación a sus proveedores de transporte a que se certifiquen, especialmente a aquellas empresas exportadoras OEA que hacen uso de los carriles exclusivos FAST y que podrían ver afectadas sus operaciones a partir del 10 de marzo de 2017.

The Fast and Express lanes are the result of the collective work between the governments of Mexico and the United States, which allow the import and export certified companies to make a faster border crossing and with a smaller number of inspections.
For the certified companies, the FAST lanes are a substantial benefit because the shipments are considered low-risk, which reduces the times in Customs and the percentages in the number of inspections, therefore, the time of its journey when skipping large rows is lower and generates greater crossings a day.
The FAST lane currently can only be used under the duly compliance of 3 requirements;
- Certified Manufacturing Company
- Certified Freight Company
- Carrier operator with FAST credential
The movement of the goods of a manufacturing Company member of the program must be made by a C-TPAT certified freight Company and the operator must have its commercial FAST operator credential to move the goods.
This last May 9th, the new foreign trade rules were published, which took effect on June 20th of this year, repealing the rules 3.8.1. and 3.8.15. relating to NEEC and certified Commercial Partner, respectively, chapter 7 is added for certified companies and certified commercial partner, where the railway carriers, industrial parks, fiscal precincts, and package delivery companies within the Authorized Economic Operator scheme.
Regarding the use of the exclusive FAST lane, in the publication of the General Rules of Foreign Trade twentieth second paragraph, establishes the following in regards to the freight companies.
- Transportation companies that the date of publication of this resolution, do not have certification as AEO certificate Business Partner, will not be able to continue using the exclusive “FAST” for a period of 10 months, from the date of publication of 9 May 2016, and even the period when his application for registration is resolved in the Certification Scheme Companies, as long as the request is made within 10 months indicated.
Therefore Transportation companies that have submitted an application for registration as a social commercial AEO certificate, but at 10 March 2017 have not received a response to its request, may use the FAST lane until your application will be determined by of authority.
With the entry into force of the new rules of foreign trade, the companies that are not under the two security schemes, C-TPAT and Authorized Economic Operator, and/or in the case of freight companies, under the modality of Certified Commercial Partner, have each time less months to keep using the benefit of this lane.
The solution to maintaining the service and delivery quality for these companies will be to dispose of human resources and materials to obtain this commercial partner certification, a process that should be made with the Tax Administration Service.
Facilities for carriers seeking certification as a trading partner certificate
- Transportation companies that have facilities that have been validated by C-TPAT within the last three years, will not be required to fill the format of the facility “Auto Carrier Terrestrial Profile”.
- To substantiate the assessment made by C-TPAT, they must attach the validation report and authorize on its website sharing information with Mexico.
- Facilities with proper credentials this facility additionally be recognized validation by C-TPAT, so the initial visit by the OEA in Mexico will not be performed.
The Director Daniella Martinez Rodriguez and the Leader Anahi Peralta Pérez of the Certifications Division NEEC/(OEA)/CTPAT of TLC Asociados, recommend that in case of searching for advisors identify if they have the experience in logistics, customs operation, process development, risk analysis, and customs security, preferably that they are certified as leader auditors in ISO28000, and of course, that in case they propose delivering already made drafts of procedures, then you’d better look for another option, since each logistic operation even when it is the same sector had different vulnerabilities, it is not just a box, trailer, tires, gasoline, and oil, in these schemes a mistake makes your company, the prestige, and the confidence before the authorities vulnerable.
By the above, are invited to extend the invitation to their transportation providers to be certified, especially those exporters OEA that use exclusive lanes FAST and that could be affected operations from 10 March 2017.
