“DEVOLUCIÓN DE PAGOS POR CONCEPTO DE CUOTAS COMPENSATORIAS REALIZADAS ENTRE ENERO Y JUNIO DE 2016 RESPECTO DE IMPORTACIONES DE MANZANAS ORIGINARIAS DE ESTADOS UNIDOS DE AMÉRICA” / ““REPAYMENT OF THE ANTIDUMPING DUTIES MADE BETWEEN JANUARY AND JUNE 2016 ORIGINATING FROM THE UNITED STATES OF AMERICA”

A partir de 2014 la Secretaria de Economía (SE) inicio una investigación administrativa por prácticas desleales de comercio internacional, en su modalidad de discriminación de precios, sobre las importaciones de manzanas originarias de los Estados Unidos de América independientemente del país de procedencia, a petición de distintos productores nacionales de manzanas.
Parte de la información proporcionada destaca, la presentada por la UNIFRUT y las estadísticas de las importaciones y exportaciones del Centro de Comercio Internacional de las Naciones Unidas en la que precisa, que en 2012 Estados Unidos se ubicaba como el segundo productor mundial de manzana cubriendo el 4% de la demanda global, siendo China el primer lugar cubriendo el 65% de esta producción. México se ubicó como uno de los principales destinos de las exportaciones de manzanas originarias de Estados Unidos con un 31%.
En este contexto, la SE publicó en el DOF del 06 de Enero de 2016 la Resolución Preliminar de la investigación antidumping en la cual determinó continuar con la investigación y la imposición de cuotas compensatorias provisionales equivalentes a los márgenes de discriminación de precios calculados, para algunas empresas productoras exportadoras americanas que se ubicaron desde el 2.44% hasta 20.82% entrando en vigor al día siguiente de su publicación, como sigue:
a) Para las siguientes empresas productoras-exportadoras seleccionadas: i) Broetje, 22%; ii) Chiawana, 8.27%; iii) Custom Apple, 5.55%; iv) Evans, 2.44%; v) Gilbert, 7.39%; vi) Northern, 9.45%; vii) Stemilt, 10.14%, y viii) Zirkle, 20.82%;
b) Para las demás empresas exportadoras que comparecieron y no fueron seleccionadas: 7.55%, y
c) Para las demás empresas exportadoras no comparecientes: 20.82%.
Hasta ese momento, la SE sostenía que derivado de la investigación y análisis existían elementos suficientes para presumir que las importaciones de manzanas de origen Estados Unidos que ingresan con la fracción arancelaria 0808.10.01 o cualquier otra, se habían realizado en discriminación de precios causando daño a la producción nacional.
Sin embargo, el día 07 de Junio de 2016 la misma SE publicó la Resolución Final de la investigación antidumping señalando la conclusión del procedimiento de investigación en materia de prácticas desleales de comercio internacional, en su modalidad de discriminación de precios, y REVOCANDO las cuotas compensatorias provisionales, toda vez que concluyó, que con base en los resultados del análisis de los argumentos y pruebas descritos en la citada Resolución, se determinó que si bien existen elementos que sustentan, que durante el periodo investigado, las importaciones de manzanas originarias de los Estados Unidos se realizaron en condiciones de discriminación de precios, éstas no pudieron ser la causa del daño alegado, por lo que no se cumplen los elementos que se requieren para tipificar la existencia de una práctica desleal de comercio internacional en términos de la legislación aplicable ajustándose por tanto, la importación de las manzanas a los beneficios y medidas señaladas en el TLCAN.

As of 2014, the Secretary of Economy (SE) started an administrative investigation due to unfair foreign trade practices, in its price discrimination modality, over the imports of apples originating from the United States of America, independently of the country of provenance, at the request of different national apple producers.
From all the information provided there is some that stands out like the one presented by UNIFRUT and the imports and exports´ statistics of the International Trade Centre of the United Nations where it is established that in 2012 the United States of America was located as the second world producer of apple, covering the 4% of the global demand, whereas China is the first place covering 65% of this production. Mexico was located as one of the main apple exports´ destinations originating from the United States of America with a 31%.
In this context, the Secretary of Economy published in the Official Journal of the Federation on January 6th, 2016, the Preliminary Resolution of the antidumping investigation where they determined to continue the investigation and the imposition of provisional antidumping duties that equal the discrimination margins of the calculated costs, for some exporting producer American companies that were found from the 2.44% to the 20.82%, entering into effect the day after of its publication, as follows:
a) for the following selected producing-exporting companies: i) Broetje, 22%; ii) Chiawana, 8.27%; iii) Custom Apple, 5.55%; iv) Evans, 2.44%; v Gilbert, 7.39%; vi) Northern, 9.45%; vii) Stemilt, 10.14%, and viii) Zirkle, 20.82%;
b) for the remaining exporting companies that appeared and were not selected: 7.55%, and
c) for the remaining exporting companies that did not appear: 20.82%.
Up to that moment, the Secretary of Economy sustained that derived from the investigation and analysis there were enough elements to presume that the apple imports originating from the United States of America that enter with the tariff code 0808.10.01 or any other, were done with price discrimination causing damage to the national production.
However, on June 7th, 2016 the Secretary of Economy published the Final Resolution of the antidumping investigation establishing the conclusion of the procedure of foreign trade unfair practices investigation, in its modality of price discrimination, and REVOKING the provisional antidumping duties, since they concluded that based on the analysis´ results of the arguments and evidence described in the Resolution, it was determined that while there are elements that sustain that during the investigated period the imports of apples originating from the United States of America were made in price discrimination conditions, these could not be the cause of the alleged damage, therefore the elements required to classify the existence of a foreign trade unfair practice in terms of the applicable legislation were not fulfilled, thus the apple imports follow the benefits and measures indicated in the NAFTA.
